Sully County court filings

Three counts of rape have been filed in Sully County against Onida resident Steve West.

The first count against West is for rape in the first degree, defined as an act of sexual penetration accomplished with a victim less than thirteen years of age.

The second count is for fourth degree rape which includes sexual penetration between a minor who is at least 13 years old but younger than 16 and a defendant who is at least three years older than the child.

The third count is for fourth degree rape which includes sexual penetration between a minor who is at least 13 years old but younger than 16 and a defendant who is at least three years older than the child.

First degree rape is a Class C felony which has a maximum sentence of life in prison and a fine of $50,000. Fourth degree rape is a Class 3 felony with a potential maximum sentence of 15 years and a fine of $30,000.

Following a bond hearing on Monday, bond was set at $50,000 with multiple conditions.
